1.2 Purpose of the site

The website www.rythmesroots.com (hereinafter "the Site") is an online shop dedicated to traditional, ethnic and folk musical instruments. The Site allows users to discover, browse and buy authentic musical products.

The Site also presents the services of the Rhythms & Roots workshop (setup, maintenance and electronics for guitars and basses, in Luxembourg) and allows users to view their prices and request an appointment.

1.3 Terminology

"Publisher" or "We": Rhythms & Roots
"User" or "You": any person accessing the Site
"Customer": any user who makes a purchase or entrusts an instrument to the workshop
"Account": the personal area created by the user

2. ACCEPTANCE OF THE TERMS

2.1 Acceptance

Accessing and using the Site implies full acceptance of these Terms of Use. If you do not accept these terms, you must refrain from using the Site.

2.2 Legal capacity

Use of the Site is reserved for persons with the legal capacity to enter into contracts. Minors must obtain permission from their parents or legal guardians before using the Site.

2.3 Applicable documents

These Terms of Use supplement the following documents:

General Terms and Conditions of Sale (GTC) — applicable to commercial transactions and workshop services
Privacy Policy — processing of personal data
Cookie Policy — cookie management

In the event of any conflict between the Terms of Use and the GTC, the GTC prevail for all commercial matters (orders, payment, delivery, workshop services).

3. ACCESS TO THE SITE

3.1 Terms of access

The Site is accessible free of charge to any user with Internet access. Access and telecommunication costs are borne by the user.

3.2 User responsibilities

The user is responsible for providing the necessary IT equipment, securing their devices and ensuring their browser is compatible.

3.3 Restrictions

The Publisher reserves the right to refuse, suspend or terminate access for any user who does not comply with these Terms of Use, without notice or compensation, and to restrict access geographically if necessary.

4. ACCOUNT CREATION AND MANAGEMENT

4.1 Creation

Some features (in particular placing an order) require the creation of a personal account, which is free of charge. The user undertakes to provide accurate and up-to-date information, to create only one account and to choose a secure password.

4.2 Login details

Login details (email and password) are personal and confidential. The user is solely responsible for keeping them safe and for any use of their account. The Publisher will never ask for your password by email or telephone. Any unauthorised use must be reported immediately.

4.3 Management

The user can at any time access their personal area, update their information, view their orders, manage their addresses and communication preferences, and change their password.

4.4 Deletion

The user can request the deletion of their account at any time via customer service or the account interface. Deletion results in permanent loss of access and deletion of personal data in accordance with the GDPR, subject to legal obligations (retention of invoices, etc.).

4.5 Suspension or termination by the Publisher

The Publisher may suspend or terminate a user's account without notice in the event of a breach of the Terms of Use, fraudulent behaviour, false information, non-payment or misuse.

5. SERVICES OFFERED

5.1 Catalogue

The Site allows free browsing of the catalogue: traditional and ethnic musical instruments, accessories, detailed product pages (descriptions, photos, characteristics, audio samples where available).

5.2 Online sales

The Site offers an online sales service governed by the General Terms and Conditions of Sale (GTC), which are separate from these Terms of Use and should be read before any purchase.

5.3 Customer area

Registered users have a personal area to manage their information, view their order history, track deliveries, access invoices and create wish lists.

5.4 Newsletter

With the user's consent, the Publisher may send newsletters (new products, promotional offers, cultural information). The user can unsubscribe at any time via the link in each email or from their personal area.

5.5 Workshop

The Site presents the workshop services and their prices, and allows users to request an appointment or a quote. A request made via the Site does not bind the Customer: the contract is only formed once the quote or intake form has been accepted in writing. Workshop services are governed by article 15 of the General Terms and Conditions of Sale (GTC).

6. USER OBLIGATIONS AND RESPONSIBILITIES

6.1 Proper use

The user undertakes to use the Site fairly, for its intended purpose and in compliance with these Terms of Use, applicable laws and regulations, the rights of third parties, public order and public decency.

6.2 Prohibited conduct

It is strictly prohibited to:

Use the Site for illegal or fraudulent purposes
Attempt to gain unauthorised access to IT systems
Introduce viruses, malware or any malicious code
Carry out web scraping or automated data extraction
Impersonate another person or create multiple fake accounts
Publish offensive, defamatory or discriminatory content
Disrupt the normal operation of the Site or circumvent its security measures

6.3 Reporting

Any illegal content, abusive behaviour or security vulnerability can be reported to: [email protected]

6.4 Consequences

In the event of a breach, the Publisher may remove inappropriate content, suspend or terminate the account, permanently ban access to the Site and take legal action if necessary.

7. INTELLECTUAL PROPERTY

All elements of the Site (structure, design, texts, images, videos, sounds, logos, databases, software, etc.) are protected by Luxembourg, European and international copyright, trademark and database law. These elements are the exclusive property of the Publisher or its partners.

The user has a private, non-collective and non-exclusive right of use limited to online viewing, temporary downloading for display purposes and printing for personal use.

Without prior written permission, it is prohibited to reproduce, modify, distribute, commercially exploit, decompile, or frame or inline-link the content of the Site.

The "Rhythms & Roots" trademark and all associated logos are the property of the Publisher. Any unauthorised use constitutes infringement and is liable to penalties.

8. USER CONTENT

8.1 Responsibility

The user is solely responsible for the content (reviews, comments, photos) they publish. They guarantee that it does not infringe the rights of third parties, contains no defamatory or discriminatory statements, does not break any law and is accurate and sincere.

8.2 Licence granted

By publishing content on the Site, the user grants the Publisher a worldwide, non-exclusive, royalty-free and transferable licence to use, reproduce, adapt and distribute it for the purposes of promoting and operating the Site. This licence ends when the user deletes the content.

8.3 Moderation

The Publisher reserves the right to moderate, edit or delete any content that does not comply with these Terms of Use or that may give rise to its liability, without justification or compensation.

8.4 Product reviews

Only customers who have made a purchase or used a workshop service may leave a review. The Publisher checks that each published review is linked to a real order or service. Reviews must be genuine and based on real experience. Incentivised or paid reviews are prohibited. The Publisher does not delete negative reviews unless they breach these Terms of Use.

Users' personal data is processed in accordance with the GDPR (Regulation (EU) 2016/679) and the Luxembourg law of 1 August 2018 on data protection.

10.2 Inbound links

Links to the Site are permitted provided that the link points to the home page, does not mislead as to our services and that the source site does not contain illegal content. The Publisher may request the removal of any inappropriate link. Framing and inline linking are strictly prohibited without prior permission.

11. AVAILABILITY AND MAINTENANCE

The Publisher endeavours to keep the Site accessible 24 hours a day, 7 days a week, but cannot guarantee absolute availability. The Site may be temporarily unavailable due to maintenance, updates or technical failures. Scheduled maintenance is carried out, as far as possible, during off-peak hours.

The Publisher reserves the right to modify, supplement, remove or discontinue the Site at any time without notice. The Site is provided "as is", with no guarantee that it is error-free or compatible with all equipment.

12. LIMITATION OF LIABILITY

The Publisher cannot be held liable for indirect damage resulting from use of the Site (data loss, interruptions, content errors, acts of third parties, problems related to the user's equipment). This limitation does not apply to damage resulting from a fault on the part of the Publisher, nor to the rights the consumer holds under the law.

The Publisher is not responsible for content published by users. As a host, it has no general obligation to monitor content, but acts promptly to remove any manifestly illegal content of which it becomes aware.

The Publisher cannot be held liable in the event of force majeure (natural disasters, widespread outages, exceptional cyberattacks, government decisions, acts of war, etc.).

The user undertakes to indemnify the Publisher for any loss resulting from their breach of these Terms of Use, their published content or their unlawful use of the Site.

13. DIGITAL ACCESSIBILITY

13.1 Commitment

Rhythms & Roots is committed to making its Site accessible to as many people as possible, in the spirit of Directive (EU) 2019/882 on the accessibility requirements for products and services (European Accessibility Act), applicable since 28 June 2025, and of the Web Content Accessibility Guidelines (WCAG 2.1) published by the W3C. As a microenterprise, Rhythms & Roots is not subject to the obligations of this directive for its services, but follows it on a voluntary basis.

13.2 Target level

We aim for AA conformance with WCAG 2.1. Continuous improvements are being made to:

Continued use of the Site constitutes acceptance of the new Terms of Use.

15. GOVERNING LAW, MEDIATION AND JURISDICTION

These Terms of Use are governed by Luxembourg law and European Union law (Luxembourg Civil Code, Luxembourg Consumer Code, GDPR, Directive 2000/31/EC).
